TERMS OF USE – CONDO MUSIC

Brand: Condo Music
Owner: Kerem Gülcubuk
EUIPO Registration No.: 018434707
Effective / Valid from: October 2026 for all license purchases and studio commissions
Jurisdiction / Scope: Worldwide

By purchasing a license or commissioning studio services, you accept these Terms of Use.

§1 LICENSE TYPES & USAGE RIGHTS

By purchasing a license, you obtain a time-limited, non-exclusive right of use – not ownership. No sublicensing or redistribution to third parties.
All leasing licenses (Basic, Standard, Pro) are valid for 10 years from the purchase date.

Notes:
• All leasing licenses include the producer tag.
• YouTube monetization only with prior whitelisting by Condo Music.
• Content ID systems may be active.
• Prices are stated subject to the German small-business scheme under Section 19 of the German VAT Act (UStG), where applicable (no VAT shown).

§2 COPYRIGHT & RESTRICTIONS

All copyrights in beats, mixes, arrangements and provided files remain – to the extent permitted by law – with Condo Music or the respective rights holder.
You obtain a usage license within the scope of the chosen license type – not ownership of the work.
Copyright as such is inalienable (Section 29 (1) German Copyright Act – UrhG); only rights of use may be granted (Section 31 UrhG).
Resale, sample repackaging, or redistribution on third-party platforms outside the licensed use is prohibited.

§3 PRODUCER TAG & CREDITS

The producer tag remains on all leased beats.
Removal is only allowed with an Exclusive license and written permission from Condo Music.
All official releases must include the credit: “Produced by Condo Music”.

§4 YOUTUBE, CONTENT ID & MONETIZATION

For Basic, Standard and Pro: 1 music video is allowed; monetization only with prior whitelisting.
Unauthorized uploads may be claimed via Content ID; in such cases, revenue from the claim goes to Condo Music.
Additional videos require a new license or an upgrade.

§5 PROHIBITED USE

In particular, the following is not permitted:
• Use in NFTs or blockchain-based projects
• Sale as loops, samples, or sample packs
• Merch use without prior written consent
• Use in political campaigns or discriminatory content

§6 EXCLUSIVE LICENSE – TERMS

By purchasing an Exclusive license, you receive exclusive, unlimited-in-time rights of use as set out in a separate Exclusive agreement; the inalienable copyright remains with the producer by operation of law.

Unless otherwise agreed in the Exclusive agreement:
• Audio license: one-time, non-transferable (no assignment of Exclusive rights to third parties without Condo Music’s consent)
• Commercial usage rights included as described in the Exclusive agreement
• Publishing / copyright splits (where co-authorship / creative contribution applies):
– Beat only: 50% Condo Music / 50% Artist
– With hook: 25% producer (Condo Music)
– With topline/vocals: 10% producer (Condo Music)
• Tag may be removed with written approval
• Content ID must be discussed before release
• Exact terms (including sync and master revenue share) are negotiated individually and set out in the Exclusive agreement

§7 BACKUPS & STUDIO POLICIES

• You are responsible for backing up your project files; Condo Music is not liable for data loss after delivery.
• Studio packages include up to 3 revisions unless otherwise agreed.
• Third-party material (beats, samples, recordings) only with proven clearance – see §9.
• Studio overtime: €100 per hour.

§8 SYNC LICENSING & PLACEMENTS

Leasing licenses (Basic, Standard, Pro) and Exclusive licenses do not automatically include sync rights.

Use of beats or songs derived from them in visual media — including films, series, commercials, video games, trailers, podcasts, or social media ads — is only permitted with a separate written sync approval from Condo Music.

Any unauthorized sync use may result in immediate license termination, removal of the content, and legal action. Condo Music reserves the right to reject placements in certain types of content (e.g. political campaigns, adult content, gambling ads).

External sync offers must be reported to Condo Music without delay. You have no automatic right to sync revenue; each sync fee is negotiated individually.

Sync inquiries: contact form at condo-music.com/contact or email support@condo-music.com.

§9 CUSTOMER-PROVIDED AUDIO / THIRD-PARTY BEATS & SAMPLES (INDEMNIFICATION)

(1) If you, as the commissioning party, bring or digitally provide your own beats, instrumentals, samples, recordings or other audio material for processing (in particular recording, mixing, mastering, editing), you warrant that you hold all necessary copyright, neighboring, license and adaptation rights — including all required sample clearances and consents of rights holders.

(2) In these cases, Condo Music (Kerem Gülcubuk) acts solely as a technical service provider. Condo Music is under no obligation to verify the completeness or validity of the rights chain or clearances.

(3) You shall fully indemnify and hold harmless Condo Music (Kerem Gülcubuk) and any assistants engaged, on first demand, against all third-party claims — in particular under copyright, neighboring rights, licensing and trademark law — including the costs of legal defense (reasonable attorneys’ fees and court costs) and any damages.

§10 BREACH & CONSEQUENCES

In the event of a breach of these Terms or of the applicable license, Condo Music may in particular:
• terminate the license immediately,
• impose a retroactive monetization block and/or Content ID claims,
• take legal action including claims for damages.

§11 REVENUE SHARE & PUBLISHING

A) Non-exclusive beat leases (Basic / Standard / Pro) – within stream caps

As long as the usage limits of the respective leasing license in §1 are observed (in particular the stream cap of up to 500,000), you owe Condo Music **0% master revenue share** on the master revenue of the licensed track.

B) 10% master revenue share – Exclusive or exceeding leasing limits

A master revenue share of **10% of net proceeds** (from 100,000 streams or as otherwise agreed) is owed if:
• an **Exclusive license** has been purchased (unless otherwise agreed in the Exclusive agreement), **or**
• the leasing limits (streams, sales, videos, radios under §1) are **exceeded** without a timely upgrade to a suitable higher license or Exclusive.

Net proceeds include in particular: streaming, sales (physical/digital), monetized live performances related to the work, related merch, sync deals, advertising and other licensing income attributable to the track or derived work.

Disclosure: Upon Condo Music’s request, you shall disclose relevant earnings information (e.g. distributor/label statements). Condo Music may request access to suitable evidence.

C) Publishing / copyright split (GEMA / PRO)

Where co-authorship or creative contribution applies, and unless otherwise agreed in writing, the publishing / copyright split is **50% Condo Music / 50% Artist** (GEMA or the competent collecting society / PRO).
Without creative input by the artist (e.g. pure ghost production), the split may be redefined by agreement.

§12 JURISDICTION & GOVERNING LAW

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) where applicable.

The exclusive place of jurisdiction is Munich, Germany, if you are a merchant, entrepreneur within the meaning of Section 14 of the German Civil Code (BGB), or a legal entity under public law or a special fund under public law (Section 38 of the German Code of Civil Procedure – ZPO).
For consumers, the statutory places of jurisdiction apply.

Mandatory consumer protection provisions of the country of your habitual residence remain unaffected where they apply.

§13 LANGUAGE & INTERPRETATION

These Terms exist in German and English. In case of conflict or ambiguity, the German version shall prevail.

§14 RIGHT OF WITHDRAWAL, DIGITAL CONTENT & CHARGEBACKS

A) No blanket waiver
There is no blanket exclusion of the statutory right of withdrawal.

B) Studio services (consumers)
Consumers have a 14-day right of withdrawal under Section 355 of the German Civil Code (BGB) for off-premises and distance contracts, where provided by law.
The right of withdrawal for service contracts expires under the conditions of Section 356 (5) BGB — in particular for paid services upon full performance if, before performance began, you expressly consented to performance beginning before the withdrawal period expires and confirmed your knowledge that the right of withdrawal expires upon full performance (and any further statutory requirements, e.g. transmission of consent on a durable medium for off-premises contracts).

C) Instant digital downloads (beats / stems / digital content)
For contracts for the supply of digital content not supplied on a tangible medium, the right of withdrawal expires under Section 356 (6) BGB if Condo Music has begun performance (provision / download) and — for paid contracts — you expressly consented to performance beginning before the withdrawal period expires, confirmed your knowledge that the right of withdrawal expires, and were provided with a confirmation pursuant to Section 312f BGB.

D) Chargebacks in case of abuse
In case of abusive chargebacks, fraud or payment disputes without a valid withdrawal or other statutory claim, Condo Music may revoke the license concerned and prohibit further use. This does not restrict the statutory right of withdrawal.

Please send withdrawal notices to: inside@condo-music.com

§15 CREATIVE ATTRIBUTION

The producer (Condo Music) must be credited as the official creator on relevant platforms, including Spotify (track credits / metadata), YouTube (description) and Apple Music / Tidal where technically possible.
If the credit is missing despite reasonable possibility, the license may be revoked.

§16 RELEASE LOCKING RIGHTS

In case of any violation, Condo Music reserves the right to request takedowns or block releases through third-party distributors (e.g. DistroKid, iMusician, TuneCore, etc.) until the issue is resolved or an agreement is reached.

§17 BLACKLIST & FUTURE LICENSE BAN

Repeated or deliberate violations may result in a permanent ban from purchasing further licenses and offers.
